Exercising Discretion when making an Allocation Decision

  1. The Allocation Policy will only allow a certain amount of discretion when making a decision on an application.
  2. Discretion decisions can only be made by the Housing Allocations and Enabling Officer or Assistant Director of Community and Housing.
  3. If a case is deemed to be outside the policy, the officer dealing with the case should complete a report stating the relevant facts of the case and reasons why the discretion should be applied.
  4. If the senior officer agrees to a discretionary decision it should only be in cases regarding:
    • Banding
    • Bedroom need
    • Nominations
    • Local connection
    Discretion cannot be applied with regards to eligibility as these are statutory rules.
  5. If discretion is applied to an application the senior officer needs to sign the report and state why they agreed.
  6. If discretion is not applied the  officer should state the reason(s) why and pass the case back to the case officer to finish processing
