Planning Obligations
 
2.76 Planning obligations are a useful tool in securing benefits to the community from development. A planning obligation or agreement is a legal agreement between a local planning authority and a developer, or offered unilaterally by a developer, ensuring that certain works related to a development are undertaken. Such agreements are usually made under the provisions of Section 106 of the Town and Country Planning Act 1990.

2.77 The Council will seek to use such mechanisms where appropriate to secure wider community benefits from a development. In such cases the following policy will apply:

POLICY HP21 - PLANNING OBLIGATIONS
The Council will seek planning obligations and the provision of related benefits in all types of development. Such obligations and benefits will be properly related to and appropriate to the locations, scale and nature of the development and local social and environmental needs.
