Consent Conditions

 

Local Government (Miscellaneous Provisions) Act 1982

General


  • The consent holder will indemnify Essex County Council and Rochford District Council against all claims in respect of injury, damage or loss arising out of the grant of the permission.

 

  • The consent holder will have public liability insurance in the sum of £5,000,000.00 that must be in force during all trading times. Proof of insurance will be required prior to the issue of the licence.

 

  •  The consent may be terminated, with one months notice, should the Highway Authority require the land for any genuine highway purpose.

 

Trading Site

 

  • Trading shall only be permitted from the site(s) specified in this Consent.

  • Trading shall not cause an obstruction of the adjacent street (including forecourts, roads, footways or other areas), and shall not endanger persons using areas adjacent to the trading site.

  • Trading shall not cause a nuisance or annoyance by any means, including noise, smells, etc. to persons using the street or otherwise.
  • Satisfactory facilities shall be provided for the hygienic storage and disposal of waste water.

  • Satisfactory facilities shall be provided for the hygienic storage and disposal of litter and refuse.

 

  • The trading site shall be kept free of litter and refuse.

Trading Times

 

  • Trading shall only be permitted on the days and between the hours specified on this Consent.

Trading Vehicle and Permitted Goods

  •  

  • Details of trading vehicle e.g. A white Bedford van registration no. BBY 182V shall only be used for trading.

 

  • Trading shall only be permitted in the goods specified on this Consent.

 

Display Consent

 

  • A clear and legible copy of the Street Trading Consent shall be displayed in a prominent position on the trading vehicle

 

Alterations to Consent

 

  • Any transfer of the business must be notified immediately to the Head of Housing, Health and Community Care.

 

  • If you change your home address, you must immediately notify the Head of Housing, Health and Community Care.
  •  

  • Your trading site, times, vehicle and permitted goods specified in this Consent must not be altered.  If you wish to vary your Consent you must apply in writing to the Head of Housing, Health and Community Care providing full details of the proposed changes.
